James Madison Barnett Will

County of Parker

   Know all men by these presents, that I J.M. Barnett, of the County of Parker, State of Texas, being in good health, and of sound and disposing mind and memory, and fully realizing the uncertainty of life and the certainty of death and being desirous of settling my worldly affairs while I possess the capacity and strength so to do, hereby make and publish and declare this my last will and testament hereby revoking all other wills heretofore make by me, that is to say:

   First: I direct that all my property and estate of which I may die seized and possessed shall be kept together and that no division be made of it until the death of my wife, Mattie Barnett, and that she may manage the same with the advice and assistance of my son, William Barnett, save and except a sufficient amount of said prop–may be sold to pay all of my just debts and funeral expenses, and expenses of my last sickness.

   Second: I give and bequeath to my grandson D.L. Baker, the sum of Four hundred dollars, which is to be in lieu of his mother’s interest in my estate if she was living.

   Third: I give and bequeath the remainder of my estate, both real and personal property to my six children, to be divided equally among them.

   Fourth: I hereby appoint and constitute my son, William Barnett, my sole executor of this my last will and direct that no bond be required of him, and that no action be had in the probate court under this will other than the filing of an inventory and appraisment and list of claims, as required by law.

   In testimony of all which, I hereunto set my hand, at Weatherfore, Texas, in the presence of subscribing witnesses. This 22 day of December A.D. 1928

   The above and foregoing last will and testament of J.M. Barnett, is now here, at the request of the said J.M. Barnett and in his presence, withnessed by us in the presence of each other, and we at his request aforesaid, hereto subscribe our names as witnesses, in the presence of the said J.M. Barnett, and in the presence of each other.

   This 22 day of December A.D. 1928
